Severance in Maine: the rules on your way out

Severance itself is almost never required by law — but the paper around your exit is. In Maine, three state rules shape your negotiation: when your last paycheck must arrive, whether a non-compete can follow you to your next job, and what notice a layoff required. If you are 40 or older, the federal clocks (21 or 45 days, plus 7 days to change your mind after signing) apply on top of everything here.

Your thinking-it-over clock in Maine

Federal rule only — no Maine statute found giving a general state consideration/revocation period for severance or settlement agreements beyond the federal OWBPA. (Maine's 3-business-day pre-signing copy rule in 599-A applies to non-competes, not to severance releases generally.)

Non-competes in Maine: restricted — enforceable only within limits

Non-competes are contrary to public policy and enforceable only to the extent reasonable and no broader than necessary to protect a legitimate business interest. BANNED outright for (a) employees earning wages at or below 400% of the federal poverty level (about $63,840 for a single-person household in 2026, per secondary calculation from HHS guidelines) and (b) non-owner licensed veterinarians. Employer must disclose before an offer that a non-compete will be required and provide a copy at least 3 business days before the employee must sign. A non-compete (other than with physicians) does not take effect until the later of 1 year of employment or 6 months after signing. Violation of the ban/disclosure rules carries a fine of not less than $5,000.

Why it matters at the exit table: a non-compete you sign on the way out can matter more than the severance check. If the clause would block your next job, narrowing it is one of the most common — and most granted — negotiation asks.

Your last paycheck in Maine

An employee leaving employment must be paid in full no later than the employee's next established payday. (The subchapter also defines 'reasonable time' after a demand as the earlier of the next regular payday or not more than 2 weeks after the demand.)

Unused vacation: Vacation pay on cessation has the same status as wages earned. All unused paid vacation accrued under the employer's policy on/after Jan. 1, 2023 must be paid on cessation — UNLESS the employer has 10 or fewer employees or is a public employer; a collective bargaining agreement addressing vacation pay on cessation supersedes this rule.

Final pay is owed whether or not you sign anything. If the date passes without your money, your state labor agency takes these complaints — and many states add penalties for every day of delay.

Layoff notice in Maine

Maine has its own layoff-notice law (a mini-WARN law): Maine's law is a combined notice + mandatory severance law, not a classic mini-WARN clone.

Notice failures have their own remedies (back pay for each day of missed notice, in the federal law's case) — separate from the severance agreement, and worth a question if your layoff was large and sudden.
